These travel conditions apply between Toppen af Danmark F.M.B.A. as intermediary and you personally, or through any other agreement with the company, as stated in the confirmation.

If you book a package holiday - which is defined as a package of travel services put together in advance by Toppen af Danmark and offered at a single price and clearly presented as a 'package holiday' - you are referred to our Conditions for Package Holidays (see below).

If you want to buy a gift voucher, the conditions at the bottom of the page apply.

BOOKING CONDITIONS applicable for:

ACCOMMODATION, ACTIVITIES AND OTHER TOURISM PRODUCTS

(Offered as a single product and not part of a package holiday)

1. PRICES

Prices on the website are quoted in Danish kroner unless otherwise specifically stated.

We reserve the right to make changes due to price and exchange rate changes beyond our control after this date.

2. WHEN IS MY BOOKING BINDING?

The purchase/booking is binding on you as soon as it is confirmed in writing by Toppen af Danmark. These terms and conditions apply from this moment, regardless of whether you have paid in full or in part for the event, or not at all. Toppen af Danmark is only the intermediary of the purchased service, which is why the supplier of the services is responsible for any defects. Different cancellation terms may apply within the same product category, so please be careful to check the terms for the individual booking.

Please note that Toppen af Danmark is not bound by the agreement until you have received our acceptance. Toppen af Danmark makes reservations for errors in pricing, failure to update the website or sold out/discontinued services. The website is not to be regarded as a binding offer from Toppen af Danmark.

3. WHAT, WHEN AND HOW DO I PAY?

You pay according to the terms and conditions at the time of booking both over the phone and online, and only by credit card. To protect and encrypt your credit card information as it travels through our system, we use Secure Socket Layer (SSL) technology.

Please note that sometimes refunds are not available for special rates and special offers. Please check the room and rate details carefully before booking.

A fee of DKK 150,- will be charged for payment via invoice

4. CANCELLATION INSURANCE

Toppen af Danmark does not offer travel insurance.  

5. TRAVEL INSURANCE

Participation is at your own risk and no insurance is included during the trip. 

6. CANCELLATION COSTS

Cancellations not covered by cancellation insurance can be made according to the following rules:

If you want to change or cancel your booking, please follow the instructions in the confirmation email.

The following charges apply in connection with cancellation, unless otherwise described in your confirmation:

Cancellation or change of a single hotel room, Bed & Breakfast room:

Unless otherwise specifically stated in your booking confirmation, which you have received by email, any cancellations or changes must be made no later than 12:00 noon the day before arrival. If cancelled or changed later than 12:00 noon the day before arrival, the next night will be charged. No-shows without cancellation will be charged 100 % of the booking price, so remember to cancel if you are prevented.

Special cancellation or change terms may apply to certain offers or discounts and will be stated in your booking.

Cancellation or change of a single hostel room:

Any cancellations or changes must be made no later than 7 days prior to arrival. Cancellations or changes made later than 7 days before arrival or no-shows will be charged 100 % of the booking price.

Cancellation and changes to holiday homes, cabins and apartments:

Any cancellation or change must be made no later than 45 days prior to arrival. If cancelled or modified later than 45 days before arrival or in case of no-show, 100% of the booking price will be charged.

Special cancellation or change conditions may apply for certain holiday homes, cabins and apartments or in connection with offers or discounts. This will be stated in your booking.

Cancellation and change of camping:

Any cancellation or change must be made no later than 30 days prior to arrival. If cancelled or changed later than 30 days before arrival or in case of no-show, 100% will be charged of the booking price.

Cancellation or change does not apply to certain offers or discounts.

Cancellation and change of activity, event, tickets or transport:

Cannot be cancelled or changed unless otherwise stated in the booking confirmation.

Cancellation - general terms and conditions

Cancellations and changes are made online at book.toppenafdanmark.dk. You can find your booking under 'My page'. If you have problems completing your cancellation or change, you can contact booking@toppenafdanmark.dk - You will receive confirmation of your change within 24 hours.

Refunds are not guaranteed if cancellations are made via the accommodation - who will therefore refer you to Toppen af Danmark.

Please note that your cancellation is not valid until you have received written confirmation of your cancellation from Toppen af Danmark.

Please note that certain discounts or offers cannot be changed or cancelled. No refunds will be made in the event of a "no-show". Fees related to changes, invoicing and cancellations are non-refundable. Unused tickets and similar must be returned as soon as possible.

Extra bankruptcy protection - COMPREHENSIVE TRAVEL

Under certain circumstances, a composite travel arrangement may be established by the Travel Services you book.

If you book several separate travel services relating to the same travel purpose during the same visit to the booking portal (website) or within 24 hours of the first booking - and the additional service amounts to more than 25% of the total purchase price, the travel services become part of a composite travel arrangement. In that case, Toppen af Danmark F.M.B.A. has, as required by EU law, established protection via the Travel Guarantee Fund to refund your payments to Toppen af Danmark F.M.B.A. for services not provided as a result of Toppen af Danmark F.M.B.A. bankruptcy or insolvency.

Note: This does not guarantee a refund in the event of bankruptcy or insolvency of the relevant service (e.g. bankruptcy of the accommodation or activity provider).

Note: A composite travel arrangement does not give you the same extended cancellation options as when booking a pre-packaged trip/package. Cancellation follows the conditions above.

If, after having selected and paid for a travel service, you order additional travel services for your trip or holiday through this booking portal, you are not covered by the rights applicable to package travel under Directive (EU) 2015/2302. Toppen af Danmark F.M.B.A. is therefore not responsible for the correct delivery of these additional travel services. This means that all additional bookings follow the conditions of the selected products.

7. MODIFICATION COSTS

In some cases, it is possible to make changes to your booking for a fee. The fee per change is fixed at 100,- If the price of the service has increased in the meantime, we will calculate a new total price.

8. COMPLAINTS

Any complaints should be addressed to the product manager, for example the hotel manager/manager of the golf course etc. or their representative, as soon as possible. You lose the right to complain if you do not notify the local product supplier. If you leave the accommodation, golf course or event without the organiser having had reasonable time to resolve the issues, you lose your right to compensation. Any claims for compensation must be received by Toppen af Danmark no later than 30 days after the end of the trip.

9. BASIS OF AGREEMENT

Group travel and special arrangements are not covered by these rental conditions, as special agreement rules apply to these types of travel. For all other bookings, the above general terms and travel conditions apply, unless special terms are stated on the booking. Toppen af Danmark makes reservations for misprints and omissions in printed and electronic material, including brochures, websites etc.

10. GENERAL DATA PROTECTION REGULATION (GDPR)

Toppen af Danmark F.M.B.A. processes personal data that you provide to us. Personal data that will be processed includes, but is not limited to, name, date of birth, gender, address, email address and telephone number. We may also process information registered in connection with an order, such as age, special dietary requirements. You submit the personal data yourself in connection with payment arrangements, account creation or other services online or by telephone.

CONDITIONS FOR PACKAGE HOLIDAYS

Toppen af Danmark F.M.B.A. is responsible for booking on this site and is the supplier of the package holiday. Toppen af Danmark is therefore responsible for the delivery of the service and enquiries regarding the package holiday must be directed to Toppen af Danmark.

4. PROTECTION VIA THE TRAVEL GUARANTEE FUND

Toppen af Danmark F.M.B.A is registered with the Travel Guarantee Fund no. 3333 and fulfils all mandatory requirements for collateral and finances.

When the combination of travel services offered to you is a Package Holiday, cf. Directive (EU) 2015/2302, you will be covered by all EU rights for Package Holidays. Toppen af Danmark F.M.B.A. is fully responsible for the correct delivery of the overall Package Holiday.

Toppen af Danmark F.M.B.A. has also set up statutory protection to refund your payments and, if the Package Holiday includes transport, secure your repatriation in the event of bankruptcy or insolvency.

Key rights under Directive (EU) 2015/2302

You will receive all important information about the Package Holiday via the Toppen af Danmark F.M.B.A. website before entering into the travel agreement. Toppen af Danmark F.M.B.A. is responsible for the correct delivery of all travel services included in the agreement.

5. INSURANCE

We offer cancellation insurance that covers cancellation due to illness prior to the trip. It is priced at 6% of the total value of the booking. See insurance terms and conditions

Travel insurance: Participation is at your own risk and insurance is not included during your stay. Toppen af Danmark refers to booking travel insurance with Gouda Travel Insurance after the trip has been booked. 

6. CHANGES AND CANCELLATIONS

Changes to your journey:

In some cases it is possible to make changes to your booking for a fee. The fee per change is fixed at DKK 100,-. If the price of the service has increased in the meantime, we will calculate a new total price.

You can transfer the Package Holiday to another person, no later than 7 days before the arrival date and possibly against payment of additional costs. You will be charged a change fee of DKK 100,-. Changes can be made online or by contacting customer service at booking@toppenafdanmark.dk  or tel +45 98 44 13 77

The price of the Package Holiday can only be increased if special costs increase (e.g. fuel prices) and if this is expressly stated in the agreement, and in no case later than 20 days before the start of the Package Holiday. If the price increase exceeds 8% of the price of the Package Holiday, the traveller may terminate the agreement. If the Tour Operator reserves the right to a price increase, the traveller is entitled to a price reduction if the relevant costs decrease.

If, after the commencement of the Package Holiday, essential elements of the Package Holiday cannot be provided as agreed, you will be offered suitable alternative arrangements at no additional cost.

Cancellation:

You may terminate the contract without payment of a cancellation fee and receive a full refund of all payments if any of the essential elements of the Package Holiday, other than the price, change significantly. If, after the commencement of the Package Holiday, essential elements of the Package Holiday cannot be provided as agreed, you are entitled to suitable alternative arrangements at no additional cost.

You may terminate the agreement without payment of a termination fee before the start of the Package Holiday in the event of extraordinary circumstances, for example if there are serious security issues at the destination that are likely to affect the Package Holiday. The extraordinary circumstances must have arisen or significantly worsened after the conclusion of the agreement

You may also terminate the agreement at any time before the start of the Package Holiday by paying an appropriate and justified termination fee (see section Fees - Package Holidays).

FEES for cancellations that are not due to illness or extraordinary circumstances.

Accommodation:

Accommodation cancellation fees follow the agreement we have with the property and will vary by accommodation type, period and price promotion.

When selling overnight stays in connection with. package tours, Toppen af Danmark has a limited right of cancellation in relation to its suppliers, which is why your right of cancellation does not differ from that which exists between Toppen af Danmark and our suppliers. This means that Toppen af Danmark does not earn income when you cancel against payment of a fee by selling the activity/accommodation to another party.

For detailed information about cancelling individual packages, please follow the information in your booking confirmation.

Entrance/activity/ticket:

Concert tickets, festival tickets or tickets for other date-specific events cannot be cancelled. This is due to the terms we have with the suppliers. 

Other activities and entrance tickets follow the cancellation policy of the individual supplier as stated in your booking confirmation.

You may terminate the agreement without payment of a termination fee if services are not performed in accordance with the agreement and this materially affects the provision of the Package Holiday and we fail to remedy the problem

You are also entitled to a price reduction and/or compensation if the travel services are not delivered or delivered defectively.

7. PROTECTION IN THE EVENT OF BANKRUPTCY

If we go bankrupt or become insolvent, payments will be refunded. If we go bankrupt or become insolvent after the start of the Package Holiday and if the Package Holiday includes transport, your repatriation is guaranteed. Toppen af Danmark F.M.B.A. Has set up protection against bankruptcy or insolvency with Rejsegarantifonden - Haldor Topsøes Allé 1 - 2800 Kongens Lyngby - cvr: 86484218.

8. COMPLAINTS

Toppen af Danmark is the organiser of the package tour and all enquiries and any complaints must therefore be addressed to Toppen af Danmark.   

You lose your right to complain if you do not notify Toppen af Danmark without undue delay after discovering the defect. If you leave the accommodation or event without the supplier or Toppen af Danmark having had reasonable time to solve the problems, you lose the right to compensation. Any claims for compensation must be received by Toppen af Danmark no later than 30 days after the end of the trip.

If you are unhappy with your hotel room or the product you receive, you are also welcome to find a solution with the supplier on site. They can often help you resolve problems and misunderstandings right away. This way you avoid having to start a complaint process.

Terms and conditions for purchasing a GIFT CARD

Gift vouchers are sold in any amount for use across the products on book.toppenafdanmark.dk

The gift voucher is valid for 36 months from the date of issue. You can claim the residual value of the gift card for up to one year after the expiry of the gift card, for which a fee of DKK 50,- will be charged.

The gift voucher can only be redeemed in connection with the purchase of products - including package holidays, overnight stays, activities and event tickets - and cannot be used to purchase multiple gift vouchers. If the value of the gift voucher does not cover the order you wish to fulfil, the difference can be paid by using one of the accepted payment methods. Gift vouchers and any credits can only be redeemed prior to the completion of your order.

The gift voucher can only be used for the purchase of goods at physical locations of our suppliers.

If an order paid for with a credit or gift card is cancelled, this credit will be issued as a new gift card and will therefore not be paid out in cash.

According to Danish law, you have a 14-day right of cancellation on your purchase of gift cards. If you want to make use of this right, please contact mailto:booking@toppenafdanmark.dk.

All bookings made with the purchase of the gift voucher follow the applicable terms and conditions for the product.
